MY A&R Terms & Conditions

Effective September 6, 2026. These Terms govern access to MY A&R, studio bookings, digital services, rewards, promotions, mastering, and related services offered by The Sound Gallery LLC (“TSG,” “we,” “us,” or “our”). By creating an account, booking, paying, uploading content, or using MY A&R, you agree to these Terms.

1. Eligibility and accounts

You must provide accurate, complete information and protect your credentials. Access is personal, revocable, non-transferable, and may be limited to invited artists. You are responsible for activity performed through your account. Minors may use the service only with consent and supervision from a parent or legal guardian who accepts these Terms.

2. Bookings, prices, and payment

Prices, availability, session length, engineer availability, taxes, fees, deposits, promotions, and balances shown at checkout control for that transaction. Unless MY A&R expressly shows otherwise, non-Platinum bookings require the displayed deposit before confirmation. Platinum status waives only the upfront deposit requirement; it does not reduce the session price, and the full unpaid balance remains due. Clients may pay the remaining balance through MY A&R at any time. We may require full payment before releasing recordings, masters, files, or other deliverables.

3. Cancellations, lateness, and sessions

Cancellations or rescheduling requests must be made at least 24 hours before the scheduled session. Deposits are non-refundable unless required by law; when approved by TSG, a booking credit may be issued and must be used within 90 days. Late arrival does not extend the scheduled end time. A session begins when the reserved time or creative work begins, whichever occurs first. TSG is open by appointment only and may stop a session for unsafe, abusive, illegal, or disruptive conduct.

4. Rewards, points, tiers, and promotions

Points, VIP status, Platinum status, waivers, discounts, priority access, promotional placement, and other benefits are promotional privileges—not cash, wages, property, stored value, gift cards, or guaranteed contractual entitlements. They are non-transferable, have no cash value, and may not be sold, combined, or exchanged except as expressly allowed in MY A&R. Points ordinarily expire 180 days after issuance and may be subject to inactivity adjustments and program rules displayed in the service.

TSG reserves the right, to the fullest extent permitted by law, to withhold, reduce, correct, suspend, expire, cancel, or revoke any points, tier, waiver, reward, promotion, or benefit at any time, with or without notice, for any reason we determine appropriate, including mistake, abuse, fraud, chargeback, misconduct, rule violation, program change, or no stated reason. No compensation is owed for revoked or expired promotional benefits.

We may modify or end the rewards program at any time. A Platinum deposit waiver does not deduct points and does not forgive or discount the session balance.

5. Creative services and revisions

Mixing, editing, mastering, enhancement, recording, and revision services are creative and subjective. Payment does not guarantee a particular commercial result, audience response, placement, distribution outcome, or artistic preference. Included revisions and additional-revision prices are those shown at checkout. Material changes or new creative direction may require a separate purchase.

6. Artist content and intellectual property

You represent that you own or have all rights, licenses, permissions, and clearances needed for every recording, composition, beat, sample, vocal, image, name, likeness, and other material you submit. You retain your ownership. You grant TSG a limited, non-exclusive license to host, copy, process, transmit, modify, and create service-related derivatives solely to provide, secure, support, and improve the requested services. Public promotion or TSG Radio use requires a separate affirmative opt-in; you may withdraw future promotional use, but prior lawful uses and completed campaigns may remain in records.

7. Files, storage, and backups

Files may be retained for up to 180 days, but retention is not guaranteed. You are solely responsible for promptly downloading and independently backing up all recordings and deliverables. TSG is not responsible for lost, corrupted, deleted, inaccessible, or damaged recordings, storage media, or digital data except to the extent liability cannot legally be excluded.

8. Reviews and community conduct

Reviews must be honest, respectful, relevant, and based on genuine listening. We may moderate or remove content and deny points for spam, manipulation, harassment, infringement, coordinated voting, or low-quality submissions. Reviews express the reviewer’s opinion and are not professional, legal, financial, or commercial advice.

9. Third-party services

Payments and scheduling may be processed through Square or other providers subject to their own terms and privacy practices. TSG is not responsible for third-party outages, refusals, delays, or security incidents outside our reasonable control.

10. Prohibited conduct

You may not misuse the service; impersonate another person; access another artist’s account or material; interfere with security; upload malware or unlawful, infringing, or harmful content; manipulate rewards, reviews, bookings, payments, or availability; reverse engineer protected portions; or use MY A&R to violate law or another person’s rights.

11. Availability and disclaimer

MY A&R and all services are provided “as is” and “as available.” To the maximum extent permitted by law, TSG disclaims implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, and error-free operation. Equipment failure, personnel availability, public utility outages, internet failures, acts of God, and other circumstances may require interruption, substitution, rescheduling, or cancellation.

12. Limitation of liability

To the maximum extent permitted by law, TSG and its owners, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost opportunities, loss of data, or reputational harm. TSG’s aggregate liability arising from a specific transaction will not exceed the amount you actually paid TSG for that transaction. Nothing in these Terms excludes liability that applicable law prohibits us from excluding.

13. Indemnification

You agree to defend, indemnify, and hold harmless TSG and its owners, employees, contractors, and affiliates from claims, losses, liabilities, damages, judgments, and reasonable legal expenses arising from your content, your breach of these Terms, your unlawful conduct, or your infringement of another person’s rights.

14. Suspension and termination

We may suspend or terminate access, cancel unperformed services subject to applicable refund law, or restrict features when reasonably necessary for security, fraud prevention, nonpayment, misconduct, legal compliance, or protection of TSG, artists, personnel, or third parties. Provisions that by their nature should survive termination will survive.

15. Changes, severability, and entire agreement

We may update these Terms prospectively by posting a revised effective date. Continued use after notice constitutes acceptance where permitted by law. If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions remain effective. These Terms, the checkout terms, and any signed service agreement form the entire agreement for MY A&R; transaction-specific checkout terms control if they directly conflict.

16. Governing law and contact

These Terms are governed by the laws applicable to The Sound Gallery LLC and the studio location involved, without regard to conflict-of-law principles.
